Imran Khan Granted One-Day Exemption in Toshakhana Case

Introduction:

In the ongoing Toshakhana case, the trial court in Islamabad granted former Prime Minister Imran Khan a one-day exemption from appearing in court. The case, filed by the Election Commission of Pakistan (ECP), revolves around allegations of concealing details about state gifts. Amid legal developments and pleas for exemption, the court proceedings continued, and Imran Khan was directed to ensure his presence in court on the scheduled date. Let’s delve into the recent developments in the case.

Exemption Plea Accepted:

Additional District and Sessions Judge Humayun Dilawar accepted Imran Khan’s plea for exemption, allowing him to be absent from court for a day. The court directed the PTI chief to ensure his presence in court on Monday (July 24). Imran Khan’s lawyer, Barrister Gohar Ali, submitted the plea for exemption, requesting an adjournment of proceedings until the specified date.

Objection from ECP’s Lawyer:

The Election Commission of Pakistan’s lawyer, Amjad Pervaiz, objected to the plea, arguing that no reasons were given for the defendant’s absence from court. He contended that the accused should be present during trial proceedings. However, Advocate Pervaiz was informed that Imran Khan has been summoned by the Supreme Court on Monday, leading him to request an affidavit from the former PM, ensuring his presence in the Toshakhana case after the SC hearing.

Judge’s Observation:

During the hearing, Judge Dilawar expressed annoyance at a previous objection raised by one of Imran Khan’s lawyers, stating that exemption pleas have consistently been accepted despite the accused not appearing before the court. However, the judge directed the PTI chief to ensure his presence after the SC hearing and adjourned proceedings until Monday.

Legal Developments:

At the prior hearing, two prosecution witnesses had given their statements, and Imran Khan’s lawyer, Khawaja Haris, was expected to begin cross-examination. Meanwhile, Imran Khan sought immediate relief from the Islamabad High Court (IHC) to stay the trial. However, the IHC issued a notice on the injunction request and adjourned the hearing until the following week.

Conclusion:

As the Toshakhana case continues, legal proceedings are unfolding with pleas for exemption and requests for stay. Imran Khan’s one-day exemption from court was granted, and the trial court awaits his appearance after the SC hearing. The case’s developments remain closely monitored, and further proceedings will determine the course of justice in this high-profile matter.
